is kamailio listening on a tcp socket? With the stable versions so far, the second instance should not start.
The development has support for tcp socket reuse.

1. Personnel problems are usually best not resolved by technical solutions.
2. How about renaming the "kamailio" binary and changing the init script to match, and if you like, creating a replacement for "kamailio" which simply tells people "don't do this again"?

create an alias -
alias kamailio='echo do not run kamailio from the command line'
add it to /etc/bashrc (or whatever your distro equivalent is)
