it should be possible to use it for states 3 and 4.
Lower state than 3 means that the dialog was not answered yet (no 200ok received). While SIP allows BYE at that stage to end a particular branch of the call, dialog module needs the 200ok, as it operates at dialog level, not at transaction/branch level.
