I don't think is wrong keeping the same ports in the re-INVITE that is 
switching to t38 -- rtpproxy is reusing the ports allocated for the 
session (upon matching callid and tags). Do you get any logs in asterisk 
indicating why is not considering the rtp traffic anymore?
